Overview

Commercial law, also known as business law, is the body of law that applies to the rights, relations, and conduct of persons and businesses engaged in commerce, merchandising, trade, and sales. It is often considered to be a branch of civil law and deals with issues of both private law and public law.

Most commercial disputes are heard in Commercial Court or in county business courts when the dispute relates to that particular jurisdiction. They can also be brought before the Queen’s Bench or Chancery divisions of the High Court, or the Technology & Construction Court (TCC).

Statistics

Commercial Organisations employing practising solicitors in house 

The legal sector contributes £25.7bn to the economy each year, with net exports now at £3.6bn per annum, so the growth in the sector indicated by our research is great news for the UK.

'The significant increase in the number of commercial organisations employing practising solicitors in the 12 months to 31 July 2015 reflects the central role of general counsel and in-house teams as business advisors who shape organisational risk culture and drive innovation. However, we know that in some areas, such as publicly-funded legal advice, recruitment is far more challenging.

Solicitors working in-house made up 21.6 per cent of practising solicitors in 2015, up from 15.0 per cent in 2000. This proportion is expected to grow further over the coming years.

UK litigants taking higher share of Commercial Court cases

Figures from consultancy Portland’s study show that the UK accounted for 37% of the total number of commercial court litigants in the 12 months to the end of March 2015, compared with 23% the previous year.

In total the court heard 207 cases, 88 up on the previous year. 

Of the remaining 63%, Eurasia (Armenia, Georgia, Kazakhstan and Russia) and the Middle East and North Africa had the highest regional representation outside Europe.

Clyde & Co had the most cases in the Commercial Court (22 cases), followed by Stephenson Harwood (15) and Ince & Co (seven). Jackson Parton, White & Case and Thomas Cooper represented clients in six cases each.
