Civil Law
Overview
Civil Law regulates and protects the rights of individuals in our community.
There is a difference between criminal law and civil law. For example, Civil Law can be used if someone gets injured by someone else’s behaviour. Whereas the main aim of criminal law is to prevent and punish behaviour that is undesirable in our community. One more important difference is by whom the charges can be filed: in Civil Law the private person can do this and in a criminal case it is the government who files in the charges.
Branches of Civil Law
Contract Law
Contract Law deals with agreements between two individuals. You can think of the following issues: Making up an agreement terms and conditions of the agreement and obligations of both parties. If any party neglects his obligations, he will be in 'breach of contract'.
Tort Law
Tort Law regulates the issues regarding personal injury and 'civil wrongdoing', done by one person to another, resulted in an injury or property damage.
Hereby you can think of laws concerning real property and personal property.
Personal property: You can think of jewelry, animals, patents, copyrights (etc.).
Real property: You can think of anything that cannot easily be removed, such as land, houses built and even oil and minerals.
This area of Law deals with marriage, divorce, child custody, adoption and any issues regarding family.
